Filing Form I-130 for an Immigrant Spouse

The I-130 Form is what is used to obtain a green card for a spouse. U.S. Citizenship & Immigration Services (USCIS) is looking for proof that the couple is indeed married. It can sound simple, and there are cases where perhaps it will be. But it’s not always as cut-and-dried as it might seem. 

Proof of Marriage

A good example of proof is if a couple can present joint bank statements or other bills that have both of their names. A life insurance policy or pension account where each is named as the beneficiary for the other is strong evidence. If a couple has been married for some time and living abroad, this type of documentation may be in abundance. 

But what if a couple is just recently married? Well, in addition to the marriage certificate itself, couples can still show their correspondence with each other. Credit card records that show expenses may be able to document trips taken together and other activities that demonstrate a real relationship. 

Why is the USCIS looking for this type of evidence? The authorities want to be certain that a marriage was done for the right reason and not simply as a way to get around immigration laws.
