What is the Deportation Process?

The deportation process starts when an individual is served the Notice to Appear (NTA). This document explains why Immigration and Customs Enforcement (ICE) believes the recipient has entered the U.S. illegally. The individual may also be held in a detention center before trial.

In the situation that an NTA was served, the immigration court will send details regarding the master calendar hearing about one month later. The hearing can take place a few months to a year after the NTA is received, so it is very important to make note of the date and time. If the individual misses the hearing, an automatic order of removal will be issued, and they may lose any chance of defending themselves against removal completely.

The master calendar hearing is where the individual will be able to tell the immigration judge about the type of deportation defense expected to be taken, and the merits hearing will be scheduled. It is not necessary to have an attorney at this stage in the process, however, if there is time to seek counsel before this hearing, it will most likely work in your favor.

It is imperative to have an experienced removal defense attorney at your side by the time of the merits hearing. It can take several hours or days to complete and an attorney can help you strategize to defend you against the removal. During the merits hearing, you can testify on your behalf and you will be examined by the attorney for the Department of Homeland Security. You are also allowed to present witnesses, evidence, and experts if it is relevant to your case.
