  • Waiver of Inadmissibility for Non-Immigrants: This waiver is for foreign nationals who are applying for a nonimmigrant visa at a consular post abroad and those who apply for admission to the U.S. as a nonimmigrant at a port of entry.
  • Waiver of Inadmissibility Based on Health-Related Grounds: This type of waiver is available to foreign nationals with communicable diseases of significant public interest, those with certain mental or physical conditions, and those who fail to obtain required vaccines.
  • Waiver of Fraud or Misrepresentation: This waiver can be used by foreign nationals to gain admission as an immigrant. Foreign nationals must be the spouse or child of a US citizen or lawful permanent resident to be eligible for this waiver. Foreign nationals must also establish that denying their admission would likely result in extreme hardship to the qualifying relative.
  • Humanitarian Waiver or Relief From Removal: This type of waiver remedies any underlying ground of inadmissibility that directly results from fraud or misrepresentation (willful or innocent) when the individual applied for an immigrant visa or adjustment of status.
  • Waiver to Avoid Deportation After a Criminal Conviction: This waiver is for lawful permanent residents who temporarily left the U.S voluntarily and not under an order of deportation, and are returning to a lawful unrelinquished domicile of seven consecutive years. Applicants must prove they were not convicted of an aggravated felony for which they served five years in prison. This waiver is particularly useful for those with old convictions who plead guilty to the crime before April 24, 1996.
  • Waiver of Inadmissibility for Criminal Acts: This type of waiver can be used for various criminal grounds of inadmissibility, but there are different requirements depending on the ground of inadmissibility, the date of conviction, the status of the applicant, and the concurrent application for relief (if any) the applicant is applying for.
  • Unlawful Presence Waiver: This waiver, if granted, eliminates the three– and ten-year bars for unlawful presence in the U.S if the foreign national is the spouse, son, or daughter of a US citizen or lawful permanent resident. The foreign national must establish extreme hardship to the qualifying relative if they are not admitted.
