The immigration case of Juan Carlos Hernandez Pacheco has gained national
attention due to its unusual time line, according to a recent article
in the San Francisco Chronicle. Last March, Pacheco was detained by Immigration
and Customs Enforcement (ICE) agents in southern Illinois; ICE released
the undocumented immigrant after several weeks, when he posted a $3,000
bond. After appearing in immigration court in November, he is not ordered
to reappear in court until April 19, 2021. Officials in this community,
including the local police chief, who largely supported Trump during the
election, nonetheless have rallied around Pacheco, who has operated a
Mexican restaurant for years and has been living in the U.S. for about
20 years. He lives in West Frankfort, IL, with his wife and young sons.
Pacheco’s immigration case is one of the more than half a million
cases pending in immigration courts nationwide. His case also illustrates
the enormous backlog of cases that are clogging the immigration court
system. This backlog continues to grow amid the Trump administration’s
“war on immigration.” Pacheco is one of the casualties of
this war, which was supposed to focus on immigrants with extensive criminal
records. Although Pacheco does have drunk driving convictions from 2007,
the service that he has given to his community has far eclipsed that incident
