Immigration Judge Orders Detention Center to Revise Parole Policies for Asylum Seekers

A federal district court judge has ruled that a New York detention facility must reform its procedures for determining whether immigrants claiming persecution in their native countries should be paroled. The New York Civil Liberties Union and the International Refugee Assistance Project brought the lawsuit on behalf of more than 30 immigrants seeking asylum who have remained detained for extended periods of time. Historically, immigrants seeking asylum from threatening conditions or persecution in their homelands were granted parole, which means that they were not detained while waiting for their asylum claims to be heard in immigration court. Instead, if officials found immigrants to have a credible fear of persecution if deported, they were let out of detention for purely humanitarian reasons. This practice began to decrease during the Obama administration, but has completed ceased since Trump took office in January 2017. In an executive order, Trump directed immigration officials to curb abuse of parole by immigrants seeking asylum, and only grant parole when the immigrant demonstrates that an “urgent humanitarian reasons” or a “significant public benefit” would result from parole. The judge’s ruling specified that the detention facility is required to notify those seeking asylum about the possibility of parole, in a language that they can understand, as well as the right to appeal any denials of parole. Immigrants in this position also have the right to an interview with an immigration officer, and, if denied parole, an explanation of the reasons for the denial.
