Start-Up Visa Program Delayed by Trump Administration

According to a recent CNN Tech story, the Trump Administration has formally delayed a program designed to permit foreign entrepreneurs to remain in the U.S. while establishing their start-up companies. Former President Barack Obama issued the International Entrepreneurs Rule in order to allow immigrants building fast-growing business to apply for “parole” status, which historically has been reserved for individuals seeking to work humanitarian or medical relief efforts. The executive order, announced in January, 2017, was scheduled to go into effect on July 17, 2017. However, the Department of Homeland Security (DHS) has pushed back the start date for the program to March 14, 2018. In the meantime, DHS will solicit public comments about the rule, and may choose to eliminate the program altogether. Other foreign countries, such as France and Canada, already have enacted similar programs. Without the International Entrepreneurs Rule, skilled workers must rely on one of the various visas that already exist. The problem with the currently available visas is that in order to qualify, the immigrant must prove that he or she is being paid by an employer, and subject to the employer’s hiring and firing practices. The requirements of existing visas make it virtually impossible for an immigrant worker to start up his or her own company. The Obama administration had expected the program to draw almost 3,000 applicants per year. Instead, DHS has pushed the program off in order to examine applicable immigration laws and policies. Immigrants, immigration advocates, and immigration lawyers expressed their disappointment about the postponement. Among those criticizing the Trump administration’s move were the American Immigration Lawyers Association, president of FWD.us, created by Mark Zuckerberg of Facebook fame, and the cofounder of PayPal, who was an Ukranian immigrant himself.
