Can I Still Drive Once DACA Expires?

As the protected status of participants in the Deferred Action for Childhood Removals (DACA) begins to expire over next two and one-half years, one area of major concern is the ability to continue to legally drive. Currently, DACA participants are eligible for driver’s licenses in all 50 states. Since driver’s licenses are linked to DACA status in many states, however, it is very possible that the ability to legally drive will expire although with immigrants’ DACA status. Fortunately, in the state of California, DACA participants do have some options when their status expires. The action that an immigrant must take when his or her DACA status expires depends on what type of California driver’s license he or she has. An immigrant may have either a standard Class C license, or an AB 60 driver’s license. The California Department of Motor Vehicles (DMV) can issue an AB 60 driver’s license to any resident of California, regardless of immigration status. As a result, if you have an AB 60 driver’s license at the time that your DACA status expires, your license will remain unaffected, and you still will have the right to drive. On the other hand, if you have a Class C license, your license status is likely directly linked to your DACA status. Therefore, once your DACA status expires, so does your driver’s license. If your DACA status and your driver’s license don’t have the same expiration date, then your license will remain valid until the expiration date on it. Once your Class C license expires, you will not be able to renew that license until you can show proof of legal immigration status. The good news is that when your Class C license expires, you then can apply for an AB 60 license. With the Trump administration’s termination of the DACA program, many questions continue to arise about the rights and responsibilities of current and former DACA participants.
