Over the first 10 months of fiscal year 2016, immigration judges have determined that
over 96,000 noncitizens placed in removal proceedings
were entitled to remain in the United States. This figure represents 57%
of the individual cases that immigration judges have decided so far in
this fiscal year. At this rate, the rate of successful deportation defense
cases is on track to surpass the over 106,000 individuals that immigration
judges ruled should remain in the United States after the federal government
charged them removal. About 25% of the individuals allowed to remain in
the U.S. were from Mexican, and about 44% were from three Central American
countries, i.e. El Salvador, Guatemala, and Honduras. In recent years,
individuals from Central America have consisted of large numbers of unaccompanied
children and women with their children. The Phoenix Immigration Court
had the highest rates of immigrants in removal proceedings who were successful
in legally remaining in the U.S., with approximately four out of every
five (82%) cases resulting in an individual immigrant remaining in the
U.S. The New York Immigration Court was a close second, with 81.5% of
removal cases being resolved by allowing the immigrant to remain in the
U.S. The Denver Immigration Court ranked third, with 78% of 831 individuals
successfully remaining in the country. The Immigration Courts with the
lowest rates of success in defending against deportation were the following:
Oakdale, Louisiana, Lumpkin (Stewart), Georgia, and Napanoch (Ulster)
, New York Immigration Courts. In each of these courts, who handle immigration
cases involving detained individuals, only about 11.3% to 17.5% of individuals
in removal proceedings seeking to remain in the country were successful.
