Neglect Leads to Fatalities in ICE Detention Centers

A recent report from the American Civil Liberties Organization (ACLU), Detention Watch Network, and National Immigrant Justice Center details how neglect and violation of medical care standards in Immigration and Customs Enforcement (ICE) detention centers directly led to the deaths of eight detainees between 2010 and 2012. Despite the 2009 immigration detention reforms announced by the Obama administration, medical neglect continues to pervade ICE detention facilities and contribute to the death of inmates at these detention centers. Among the most critical failings of ICE detention facilities were their failing to meet health care needs in a timely manner, failing to refer patients to specialists and/or for emergency medical care, and providing adequate levels of staffing. Detention authorities also reportedly failed to communicate critical information to staff members about detainees’ medical conditions, particularly during transfers of detainees, failed to adequately screen detainees for illnesses, and proactively identify and resolve concerns about medical care during facility inspections. In fact, in seven out of the eight routine inspections that occurred both prior to and following the deaths of these eight detainees, the facilities received passing ratings. These facts suggest a serious problem with the inspection procedures themselves. Furthermore, some ICE detention facilities have more problematic track records than others, such as the Eloy Detention Center in Arizona. Given the repeated deaths that have occurred at that facility with no actions taken to remedy the conditions that led to the deaths, the report recommends that the government contract with facilities such as Eloy terminate altogether, in favor of facilities that adequately comply with healthcare standards for detainees.
