Trump Sues California Over Sanctuary Laws

In early March, the U.S. Department of Justice (DOJ) filed suit against the state of California in a federal district court in Sacramento regarding the California Values Act, the state sanctuary law that went into effect at the beginning of the year. The lawsuit alleges that California has impermissibly preempted federal immigration law, discriminated against the U.S., and impacted public safety in passing its sanctuary legislation. Since immigration is a federal matter, the DOJ argues that California’s sanctuary law violates the constitutional principle establishing federal law as the supreme law of the land. The California Values Act prohibits local law enforcement authorities from informing Immigration and Customs Enforcement (ICE) agents that undocumented immigrants are being released from incarceration and from directly turning these individuals over to ICE. The law also bars employers from cooperating with ICE agents to conduct workplace raids seeking undocumented immigrants. Yet another provision in the law gives California officials the right to inspect immigration detention facilities for compliance with health and safety standards. According to California officials, their sanctuary laws simply are an extension of their public safety policies. The Trump administration’s lawsuit is a huge departure from previous Republican administrations, who defended other states’ similar legislation, such as Arizona’s 2010 anti-immigration legislation, as a legitimate exercise of state power.
