Immigrants at Otay Mesa Detention Center Sue CoreCivic for Forced Labor

A group of immigrants who are detained at the Otay Mesa Detention Center in San Diego, California, are suing CoreCivic, the private company that operates the detention center. The class action lawsuit alleges that CoreCivic forces detainees to work in various roles throughout the prison, for as little as $1.50 per day, or for no compensation at all. Since the private company does not provide basic necessities for detainees, then the detainees are forced to work in order to buy these necessities at the commissary. At times, the lawsuit further alleges, prison staff even threaten detainees with solitary confinement or cutting off their visitation rights if they refuse to work for free. While work programs are common in regular U.S. prisons, the lawsuit draws a distinction between criminal inmates and detainees held for immigration court proceedings. Since deportation proceedings are civil rather than criminal in nature, immigration detainees cannot be held in custody as a means of punishment; the only way that Immigration and Customs Enforcement (ICE) can detain an immigrant in deportation proceedings is if they fear that the immigrant will not reappear at future court proceedings or if the immigrant is suspected to be a danger to society if released from detention. According to ICE detention standards, which CoreCivic must meet, any work beyond basic housekeeping duties in their sleeping areas is purely voluntary and must be compensated at a minimum of $1 per day.
