What is Asylum and Who is Eligible?

What is Asylum and Who is Eligible?

Asylum is a form of immigration status for people seeking protection from persecution or have a fear that they will suffer persecution in their home country. The persecution must be based on one of these circumstances:

  • Race
  • Religion
  • Nationality
  • Membership in a particular social group
  • Political opinion

For example, a person who lives in a dangerous autocratic country, like North Korea, may be at risk of serious harm or even death for expressing ideas or opinions against the dictator. That person might qualify for asylum in the U.S. if they can prove that fear is credible.

People who are seeking asylum in the U.S. must be present in the country to apply. They lose their eligibility if they do not apply within a year of entering the country. You can find more details here.
