ICE Assaults on the Rights of Asylum Seekers

ICE Assaults on the Rights of Asylum Seekers

The American message to the world right now? If you need to escape violence, war or persecution don’t look at us. We won’t help. The U.S. Immigration and Custody Enforcement (ICE) and its leadership are conducting a pervasive misinformation campaign. They have convinced anti-immigrant extremists that all people arriving at U.S. borders have dishonest motivations. They have confused moderates who understand what the word refugee means. The ICE manipulation of clear policies in their own department is government at its worst. Asylum seekers have the right to come to the border and request asylum. Border personnel give a “credible fear” test that is supposed to let them live in the community while awaiting a hearing. They are getting locked up even if they pass the test. How is ICE evading its own rules?
  • Refusing to recognize any relationships between a refugee and a documented person or U.S. citizen as valid. In at least one case this included the refugee’s mother.
  • Denying asylum protections on anyone considered to be a “recent entrant.” All asylum seekers, be definition, are recent entrants.
  • Refusing to accept any evidence the asylum seeker has “sufficient ties” to the United States to come here. Again, by definition, few may have ties to the U.S. Unless there is verifiable information the person is a threat, they have the right to live in the community while awaiting a hearing.
