DOJ Threatens CA with Federal Subpoenas

The U.S. Department of Justice (DOJ) is threatening to issue subpoenas and cut off millions of dollars in funding to the state of California over immigration information that the state has not produced, despite DOJ demands. At issue is $18 million in federal funding that normally goes to fund the California Board of State and Community Corrections, as well as almost $250,000 in federal funds for the Sacramento County Probation Office. The DOJ’s demands arose as a result of California’s state sanctuary law, which prevents local law enforcement agencies from cooperating with or providing certain information to Immigration and Customs Enforcement (ICE) agents. More specifically, the DOJ is demanding documents from the state of California and 22 other sanctuary jurisdictions in an attempt to prove that they are violating federal immigration laws. The DOJ believes that the requested documents will show that the sanctuary jurisdictions are violating the law in restricting the information that local law enforcement agents can share with federal immigration authorities. The affected jurisdictions in the state of California include San Francisco, Berkeley, Fremont, Los Angeles, Monterey County, Sacramento County Sonoma County, and Watsonville. The requested documents include any orders, directives, instructions, or guidance to local and state law enforcement employees. Both Sacramento County Supervisor Phil Serna and California Attorney General Xavier Becerra expressed that they would not be intimated by the hardball tactics of the Trump Administration and U.S. Attorney General Jeff Sessions.
