Former detainees at a Colorado immigrant detention center run by the private prisons corporation, the Geo Group, are alleging that conditions at the facility are similar to slavery. In an attempt to keep the facility afloat with only one full-time janitor, detainees are made to clean their areas on a daily basis or face placement in solitary confinement. Detainees are paid one dollar per day for jobs as varied as landscaping, cutting hair, and more cleaning. Nonetheless, the Geo Group reported $2.2 billion in revenue and almost $163 million adjusted net income last year from running the 1,500 bed facility. A group of former detainees has won the right to sue the Denver-area detention center in federal court on behalf of the roughly 60,000 people who have been held in the facility over the last decade. This lawsuit could have major implications for the private prison companies that operate immigrant detention centers nationwide, and, most notably, for the Geo Group, which is the largest private prison operator in the United States. This is particularly the case in today’s political climate, in which the Geo Group and other private prison companies are looking to cash in on the Trump administration’s commitment to detaining and deporting thousands of immigrants. The problem lies in forcing detainees in immigrant detention facilities to work. While prison inmates can be forced to work, as they already have been convicted of crimes, jail inmates cannot be made to work, since they are normally being held pending trial. Similarly, immigration advocates claim that forcing immigrant detainees to work violates their 13 th Amendment rights against involuntary servitude, as the detainees have not been convicted of a crime.
