California Attorney General Xavier Becerra and Senator Ricardo Lara recently announced that the California Department of Justice (DOJ) will begin investigating the conditions under which immigrants are detained in California immigrant detention centers awaiting immigration court proceedings. The DOJ will examine the conditions and potential due process concerns of immigrants, whether they are detained in local, state, public, or private facilities. The DOJ must deliver a report on these conditions no later than March, 2019, and oversight of these concerns will continue until 2027. Furthermore, as of June 15, 2017, city and county jails cannot enter into new contracts or expanding existing contracts with the federal government or private prison companies to house immigrant detainees. California has continued to lead efforts to protect its immigrant citizens, even in the wake of drastically stepped-up enforcement actions by the Trump administration’s Immigration and Customs Enforcement (ICE) agents. The state is home to the largest number of detained immigrants in the nation after Texas.
