Immigration Advocates Accuse Border Patrol of Destroying Evidence

Some time ago, the National Immigration Law Center (NILC) filed a class action lawsuit against U.S. Customs and Border Protection (CBP) regarding the poor conditions in which they held detainees in Arizona immigrant detention facilities. NILC has now filed a motion with the court accusing CBP of destroying video surveillance footage that is essential to its legal case. More specifically, NILC alleges that CBP knowingly provided NILC with corrupt videos that they could not watch, recorded over other files, and said nothing about it for months, despite the ongoing litigation. According to NILC’s motion, CBP claims that an update to its operating system corrupted files, and by the time they became aware of the problem, the archived footage had been taped over. CBP has not commented due to the pending litigation, but NILC alleges that CPB has known of the destruction of evidence at least since June, 2016, but didn’t tell NILC about the problem until December, 2016. Up until now, the public has been largely unaware of the conditions that exist inside these immigrant detention facilities. Last August, however, the judge hearing the case released photographs depicting the detainee holding cell inside these immigrant detention centers. CBP already has come under fire for failing to maintain footage of two detainees involved in the lawsuit. In August, 2015, the judge ordered that CBP was not to destroy or record over any video surveillance tapes. With this latest alleged violation of that court order, NILC is claiming that it no longer has solid evidence to corroborate the testimony of detainees with respect to the physical conditions of the detention facilities.
