Thousands of Immigration Cases Backlogged in Arlington

FOX News has released a follow-up to a previous story in which its reporters found a shocking amount of immigrants awaiting hearings in Arlington Immigration Court. That report indicated that there were thousands of cases mired down in the immigration court system, with several hundred cases scheduled out as far as 2023 and 2024. FOX subsequently sent a Freedom of Information Act (FOIA) request to the Executive Office for Immigration Review. That office’s response indicated that cases no longer were scheduled in 2023 and 2024, but that they had been “brought forward.” One immigration attorney revealed that since the initial FOX News story, his long-term deportation hearings have been cancelled and replaced by so-called “master hearings,” which are preliminary or status hearings. While it may appear that hearings have been advanced in the court schedule, the reality is that master hearings are actually a step backwards in the immigration court process. Furthermore, even the master hearings are scheduled out through 2021, or four years in the future. The Executive Office for Immigration Review offered no explanation for the scheduling changes, other than the addition of an immigration judge to the Arlington Immigration Court, as well as changes that had occurred in case priority status, closures, and terminations.
