In June 2016, California Governor Jerry Brown signed Senate Bill 10 - #Health4All
- into law, which makes California the first state in the nation to request
a waiver from the federal government so as to allow undocumented immigrants
the ability to purchase health insurance through Covered California, the
state health insurance exchange. This bipartisan legislation comes on
the heels of California’ s decision to become the state with the
largest immigrant population to provide the full scope of health insurance
to all low-income children, regardless of their immigration status. Federal
law currently prevents undocumented immigrants living in California from
purchasing health insurance coverage through Covered California. However,
Section 1332 of the Affordable Care Act (ACA) provides waivers for state
innovation, which allows states to choose how to implement key provisions
of healthcare reform, beginning in 2017. Section 1332 even provides for
states to drastically depart from ACA policy and procedures if they choose
to do so while still implementing its requirements in the state. If the
waiver is granted by the federal government, Covered California will begin
offering alternative health insurance policies for undocumented immigrants.
These policies would still have to meet all of the same requirements as
other offerings through the exchange. According to California legislators,
the waiver would remove some of the barriers to health insurance coverage
for immigrants, with undocumented workers being able to choose and purchase
their own healthcare policies in the same manner as any other Californian.
