California Senator Announces Dignity Not Detention Act

Senator Richard Lara, who serves California’s 33 rd District, recently announced the Dignity Not Detention Act, a bill that is designed to combat the mistreatment of immigrants through mass incarceration and inhumane detention facilities. More specifically, Senate Bill 1289 would prohibit local city and county officials from allowing private, for-profit companies to operate immigration detention facilities in the state, as well as require that all operating immigration detention facilities adhere to national standards of humane treatment. Lara claims that the proposed act, which is co-sponsored by the Immigrant Legal Resource Center and Community Initiatives for Visiting Immigrants in Confinement, would be the first of its kind in the United States, and would allow California to enforce national humane treatment standards, which is not possible under current law. This is particularly important in the state of California, where an estimated 85% of all immigrant detainees are held at four privately-run detention facilities, which amounts to about 3,700 people. The remainder of detainees reside in county jails that contract with the federal government to do so. Widespread human rights abuses, such as physical and sexual abuse, little or no access to healthcare, overuse of solitary confinement, harassment, and discrimination have been reported to human rights groups by immigrants who were confined in these facilities. Nonetheless, these private facilities continue to operate with little oversight and no hope of remedying the ongoing inhumane conditions. The hope is that SB 1289 will send a strong message to these private entities that they cannot continue to treat detainees in this manner.
