Obama Administration Delays Some Immigration Cases, Prioritizes Others

A recent shift in the federal government’s immigration policy has led to delays in deportation proceedings, particularly for Central Americans, many of whom the U.S. is allowing to legally remain in the country for several more years. This is a huge change from the administration’s response to the surge of Central American immigrants that started in 2014, when it announced its intention to prioritize these cases by rushing them through the deportation system. Back then, the U.S. hoped to deter the arrival of even more immigrants seeking to escape the widespread violence that pervades Central American countries. Federal authorities characterize the delays in cases involving Central Americans to cost-saving measures, as well as a lapse in enforcement that resulted in immigrants who were supposed to be enrolled in an electronic monitoring program to go completely unmonitored. This program, which costs $4 to $8 per individual per day, was hampered, in large part, by confusion over whether immigrants were supposed to report to DHS or ICE. Despite the significant delays in some cases, which may stretch years into the future, DHS is moving other cases rapidly forward, sometimes by years, in order for newly hired immigration judges to address and resolve them. Aimed at decreasing the extreme backlog of currently pending immigration cases, moving up cases may actually lead to further postponements, due to a lack of notice to the immigration lawyers who are handling them. The advancement of certain cases also has led to more immigrants braving immigration court on their own, without the benefit of legal representation.
